“At yesterday’s hearing, the Royal Commissioner recommended to me that I submit to the Attorney General a term of reference relating to the safety of cyclists and a request for an extension of time to allow the Royal Commission to consider these matters.”

“I had taken an opportunity to express my disappointment that the Royal Commission was limited to events that took place after Mr Humphrey was killed without any consideration of any other circumstances that lead to his death.

“I have written & faxed a request to the Attorney General seeking a widening of the Kapunda Road Royal Commission’s Terms of Reference as per the Commissioner’s recommendation” said Ian Gilfillan, the South Australian Democrats spokesperson for cycling.

“Currently the Commissioner can only look at a set of very specific events and can make no recommendations about government road funding, Driver Education, or any facilities that need to be put in place to support road cycling in a safe environment.
“With this in mind I have recommended that the Attorney General add to the Terms of Reference to include the following:

10. You may include in your report recommendations arising from your
findings as to such reasonably practicable reforms of any law, practice or procedure that will enhance or improve the safety of cyclists on public roads in South Australia.

“I believe that this Royal Commission must empowered to examine the underlying circumstances that caused the tragic death of Mr Ian Humphrey and make recommendations for ‘bike friendly’ roads.”
