McGee’s brother warned he may need legal representation. 02/06/2005. ABC News Online
The Kapunda Road Royal Commissioner has put the brother of Eugene McGee on notice that he may need legal representation in light of potentially damaging material emerging at the commission. Craig McGee gave evidence in the District Court that he drove Eugene McGee back to Adelaide the night his brother hit and killed cyclist Ian Humphrey. Today Commissioner Greg James QC issued a temporary suppression order on a Director of Public Prosecutions document relating to the McGee investigation.
Commissioner James said the material contained in the document could be damaging to Craig McGee and that he should be contacted and told he may need legal representation at the commission. Craig McGee is likely to be called to give evidence before the commission next week. The commission has also heard that the widow of cyclist Ian Humphrey did not originally want Eugene McGee to go to prison for the hit-and-run.
The commission heard details of correspondence between prosecutors and Ian Humphrey’s widow Di Gilchrist-Humphrey. Prosecutor Teresa Anderson told the commission that early on in the investigation, Ms Gilchrist-Humphrey did not want McGee jailed if he was found guilty of causing death by dangerous driving, but had wanted McGee to undertake community service or a restorative justice program if given a custodial term. However, Ms Anderson said Ms Gilchrist-Humphrey’s attitude towards penalty hardened as she became increasingly dissatisfied with the way the case had unfolded. After being found guilty of the lesser charge of driving without due care, McGee was eventually fined $1,250 and lost his licence for a year.”
