A LAWYER who killed a cyclist in a hit-and-run accident has failed in his bid to have a charge of attempting to pervert the course of justice dismissed. Eugene McGee and his brother Craig yesterday entered not guilty pleas in the Adelaide Magistrates Court.
But this was not before their lawyers attempted to have the matter thrown out by arguing the prosecution had not provided adequate details about the allegations. The 2003 accident – in which Mr McGee hit and killed cyclist Ian Humphrey on a country road and left the scene – was also the subject of a royal commission last year.
At the time of the accident, Mr McGee was charged with death by dangerous driving. He was instead found guilty of driving without due care, fined $3100 and disqualified from driving for 12 months. Premier Mike Rann later set up a royal commission to investigate the McGee trial. The case in the Adelaide Magistrates Court has been adjourned until August to allow defence lawyers to gather evidence and prepare submissions on inadmissable evidence.
